Subject: Comments regarding Packwood Ave. view
Dear Maitland United,
I am truly sorry that you continue to use inaccurate information to intimidate the public into believing a Non-Truth.
In reference in particular to the notion that there is no “set back” and a huge 7 story hotel abutting Packwood Ave as indicated in the rendering below which you sent out this past Monday. This rendering was created by someone in the Maitland United group. It is NOT from the developer as your wording could, by some, be misinterpreted to indicate. (….”To get a more complete understanding of the proposed buildings' height and mass, the information presented by the developer was used to create computer simulated views from various common locations in our city.”)
So please do not continue to spread mis-truths that appear to be based on information from the developer himself, The truth is, that the Brossier Plan includes 15 foot wide internal sidewalks, and a step-back configuration after three stories (not a 7 story “monster”.) There is also a bike/pedestrian 15 foot wide trail on the CSX rail line in the back of the development. (this information was given to me in an email by Bob Reese, Developer)
I find it unfortunate that the Maitland United Group is really now DIVIDING our community.
I was once very much in favor of the Maitland United Group’s objectives – I made a small donation to the cause, I helped with providing computer equipment to show the Maitland United Plan at informal “coffee klatches” held at Maitland residents’ homes, I was even the “Poster Girl” holding the rendering of Maitland United’s vision for the downtown in the Maitland Observer paper. I appreciated the Grass Roots effort to let the City and others know that the citizen’s wanted input on the downtown development, (unlike what happened regarding the Villages of Lake Lily Project and others… where it was only “lip service” that the Citizen’s had input through “public workshops” when in fact these developments were basically a “done deal” by the time the citizens got involved and voiced their opinions and discontent.)
However, during my several months of involvement with the Maitland United Group, I personally found that there seemed to be little room for compromise. I felt it was exclusively the Maitland United’s Plan as rendered and that was it; no modifications were entertained. I also found that there was, at times, arrogance against certain outspoken Maitland residents by not allowing them to be involved, I voice my concern about this. And, I found that there seemed to be a committed determination to stir-up resentment against the Brossier Plan for the Downtown Development., rather than truly wanting to sit down to talk and compromise to make it work- to get us a Downtown … I felt that Maitland United continued and even today continues to show why the plan shouldn't work when in fact they really don’t know for sure.
Yes, there is higher density than many would like, yes the buildings will be taller than 3 stories… but in fact – how bad is that??? I know that when I go to a hotel, I LIKE getting a room on a higher floor. I LIKE to look out and have a beautiful panorama of the area I’m in. The financial demands to make the project work require this higher density and height. Had we done the downtown 10 years ago we would not be in this position of needing greater height and density than some people originally hoped for.
I changed my allegiance from Maitland United because I found the developer was more willing to make the project work than the Maitland “United” group.
I have witnessed over the months that Bob Reese has recognized the citizens’ pleas for limited height and has worked diligently to try to create a look that will NOT be a 7 story behemoth all around but rather the Brossier design is to integrate the 7 story buildings sporadically throughout the project in a “wedding cake” type look - stair stepped back. Bob has continued to hold weekly workshops for nearly a year wherein the public could come and listen and comment and dialogue with him to express concerns and passions and make suggestions and get involved. Over and over, I have found that he has tried to modify the project to the input received all the while maintaining a “first class” look, with design and features that we can ALL be so proud of when the downtown is complete. It will be MAGNIFICENT!
In my opinion, if we lose our present developer, and have him sell out to CVS and we get more, 1 story banks, a Chick-Fil-A and other fast food restaurants, our city will be just as “ugly” as it is now. Let’s NOT LOSE THIS OPPORTUNITY TO HAVE A BEAUTIFUL , INTEGRATED, UPSCALE, “GREEN” DOWNTOWN. I will not even go into the implications of the millions of dollars of tax revenues that will be lost if we do NOT make this integrated downtown a reality.
If one does not truly know about the business of putting large scale real estate / development deals together – one truly has no clue of how complicated, involved and intricate it is. It is easy for us as the public to think of and accuse the developer of being an “ugly ogre” who will make jillions of dollars with an attitude of “to hell with the public” - but that is far from the truth. It is an amazingly risky, long term committed, highly intense business. If anyone from the Maitland United Group is willing to come to the table and give the city tens of millions of dollars to build the Downtown with low density, 3 stories with a 2 acre park…. please come forward NOW!
I would LOVE a 2 acre park in the middle of our downtown – but economically it is not feasible, nor practical. The land in the downtown area is too valuable to not have it be “tax revenue” producing. Bob Reese has tried his darnedest to recognize the citizen’s cry for park land and open space and has incorporated what will amount to nearly 4 acres of open space/mini parks that will be probably more frequented than a massive 2 acre park. As has been said at many of the CRA/Council meetings, look at Quinn Strong Park… just 300 yards from City Hall…. How often do you see that park with more than a few people there per week??? How often does anyone go and sit in the Park just outside of City Hall. The majestic oaks ARE Beautiful… and Bob Reese has made provision to keep as many as possible where they are and those that cannot be kept there he will have moved to a different location in the downtown community (when healthy and practical.).
PLEASE, PLEASE…. MAITLAND UNITED….. it’s time for a TRUCE!
It’s time for you to STOP inciting negativity and look for the positives… Let’s work toward MAKING THIS DOWNTOWN a reality….. MAKE MAITLAND - UNITED – NOT DIVIDED!
If we delay any more, and have to wait until another developer is found and his plan goes through all the intricacies that are required – then we’re talking about at least another 2+ years which will mean that the economic feasibility of the next project will require even greater heights and higher density than what the Brossier Plan has.
This letter is not designed in anyway as a put down for the Maitland United Group. I admire and respect the participants – as I said, I once was one. This letter is designed to encourage you to “pick-up” the Group, accept compromise and motivate the group into really learning the truth so as to make downtown Maitland a reality for us all. The Brossier Plan may not be perfect in everyone’s eyes…. but it is certainly so much better than what we have now and let’s not run the risk of loosing it.
PLEASE let’s truly BE and WANT for a MAITLAND UNITED!!
Regards and thanks to all for “listening”

For a clear representation of The Brossier Company's downtown Maitland plan as it was unveiled at a past City Council/CRA meeting....please read the following article originally published in The Winter Park/Maitland Observer newspaper:
A presentation on the proposed Maitland Town Center Monday night officially launched talks between the Brossier Company and the City of Maitland on the developer’s agreement submitted earlier that day. The proposed project would be developed on the two blocks between 17-92 and Maitland Avenue with George Avenue to the North and Packwood Avenue to the South. The multi-use project will focus on retail, office and hotel space unlike other developments in Maitland that are residential based. It is designed to be sustainable and pedestrian friendly with seventy percent of the project dedicated to open space, right of way or buildings of three stories or less.
Reese proposes to create a Community Development District (CDD) within Maitland’s Community Redevelopment Area (CRA). The complex proposal allows the Brossier Company to secure financing to build the public infrastructure and insulates the city from financial liability for the bonds.
The Brossier Company estimates the Town Center project will generate more than $3 million in tax revenue for the city of Maitland upon completion of the project in 2012. This estimate is based on the utility tax, franchise fees, communications service tax and sales tax. According to the Brossier Company, other financial benefits to the city are:
· No financial liability or maintenance costs for new public infrastructure
· $30M in horizontal improvements
· $70M in total public improvements
· Annual estimated ad valorem taxes to city of Maitland in 2035 (upon expiration of the CRA district) are in excess of $14 million.
Tom Leung, President of Global Retail Strategies (GRS) in Vancouver, Canada opened the presentation with a shining review of Maitland’s market potential. After 3 months of research GRS found that Maitland is perfectly aligned with all the elements that make a successful town center. Leung said, “This is one of the top sites I’ve seen in the last 3 years, particularly in the southern states – what we call the growth states” he continued, “Maitland has potential to be the most successful lifestyle development in all of Florida if not on the eastern seaboard”
Laura Barbera Buffa of Walter P. Moore, a structural engineering firm stated that parking recommendations were based on the “shared parking”. She said that the suggested parking estimate is actually higher than industry standards and Maitland’s parking code also approves the use of shared parking. In comparison, she stated that Winter Park Village with its heavy retail and 4000-seat movie theater component would need at least 300 more parking spaces according to this formula.
Scott Martin of Baker Barrios architectural firm said the plan provides for a space with a goal of making people want to come back again and again. The architect spoke of the pedestrian friendly focus and eye level appeal with richness in materials used. All garages will be “lined” so that they appear architecturally as a building. He stated that all buildings fronting roads will be “stepped back” which means that a pedestrian would only see 3-stories from the sidewalk.
Jeffrey Manuel, of Glatting Jackson, a community planning and design firm said once Maitland Town Center is completed, this would be the largest green roof project in Florida, giving Maitland the potential to become Florida’s greenest city.
Mayor Kinson said "this city is ready to look at a development like this". And went on to make a point that this is really the very beginning saying he is going to look at every aspect of the deal and then make up his mind. Kinson also reminded city council members of their duty to act in a quasi-judicial manner when reviewing developer’s agreements.
Maitland Community Redevelopment Agency Orange County Representative John Lowndes said he had “more than 100 questions” after a cursory review of the Developer’s Agreement draft. He stated in addition to his questions, he would like to see more “meat on the bones” of the document. He said Maitland should be mindful of the benefit to the city. He also said that if Maitland is contributing land to the deal, there need to be appraisals.
The passion of the citizens is openly apparent at city meetings. Comments revealed that many residents support the Town Center concept overall and are eager to get more details. Many expressed a desire for open space in the project. Irene Stouffer referenced towns in Europe that have general spaces that encourage people of all ages to gather together, where they can sit and visit and the children can play. She asked Bob Reese if the town center will have a space where we won’t have to fight cars, where we can visit [with each other]. Reese responded that the entire town center is designed to provide for what she described. Without hesitation, she answered, ”Okay. Then I’d like to get in line to buy a condo.”

OUR LITTLE WORLD ~ Maitland, Florida

What's it all about, Maitland? Is it just for the moment we live? What's it all about when you sort it out, Maitland?
What is our little world of Maitland all about? If you were at the Monday night City CRA meeting...you learned about the position and beliefs each of our elected officials has concerning down town development.
And you learned that our City Councilmen and Mayor read their emails and form opinions based on them.
And you learned that there is a body of people who oppose any project that doesn't include a 2 acre park or doesn't match with the 1996 density guidelines or is higher than 2 or 3 stories or involves the sale of city property or...or...or...or...or.
And you learned that there is a body of people who very, very much want and understand the need for our city to include a well developed, artistically designed, fully faceted muli-use, high density, revenue generating, vibrant and distinct DownTown district.
And what you may not have learned is that if you say nothing...that is most likely what we all will get.
But if you WANT this type of project...you best write or call or email or send smoke signals or wire or ham radio or Morse code or sign or speak out at a city meeting and make your wishes KNOWN to our city officials...because decisions are being made NOW that will forever determine the future face of our city.
SPEAK OUT NOW....it's so vitally important that you do.

MAITLAND's VICE MAYOR FLOWERS ~ Speaks Out

Our Vice Mayor Jeff Flowers is doing his best to speak out to our community concerning many important details regarding our Maitland Down Town development.
If you did not receive the following email, I strongly urge you write him asking to be placed on his list (see his email address below).
~ ~ ~ ~ ~ ~ ~
Dear Maitland voters
The city is on the cusp of setting the course for all of our future. The decisions that are reached in the next few meetings will determine the shape of our new downtown and tax structure for our future as well as the future we hand over to our children. I am writing to you to share the information I have and to get your feedback on this issue that will affect all of us.
Please email me
Taxes
The Florida legislature just mandated lower taxes. This means that our city services will need an additional tax base to cover the cost of our current service level. Building a new town center will create the additional commercial business that can generate sales and other taxes that will help offset this lowered tax rate. This will allow the city of Maitland to maintain the superior services we have come to enjoy and expect.
Tax Increment Financing (TIF) is essentially tax revenue above and beyond the taxes already being paid to the city. Florida Statutes specify that the TIF income derived from new construction may only be spent on specific things such as infrastructure and not end up in the general fund. So, using TIF revenue to repay infrastructure costs in the town center is actually the only option for that money. Whether infrastructure is built in the town center or anywhere in the CRA, the same portion of TIF revenue still may only be used for infrastructure per the inter-local agreement Maitland has with Orange County.
With the Brossier plan to create a Community Development District (CDD) the city will not be required to guarantee the bonds. The CDD will take out the loans. In other words the city does not have to “co-sign” for the loans to build the town center and will not be financially responsible in any way if a CDD is created. This means that city taxes will never be increased to pay for the downtown’s new infrastructure no matter what, since the city is not financially responsible nor involved in the building of the site. Clearly this is something we have to consider going forward.
City Emergency Services Building(s)
The original plan had this building located next to the Presbyterian Church on George Street. The church objected to that placement so that site is not available. The existing plan saves 30% of the cost to construct a larger Fire House than the earlier plan. It has a central location that will improve our response time. The new plan can be expected to start building late 2007. Our Firefighters deserve our community support now. The existing 'facility' is a shame. Prices to build have increased in the 3 years that we have not built. We need a cost savings to be able to use the funds we have available to get the job done.
Downtown
We don't have one now. We need the economic engine that a viable City Center provides to allow us to build out our QNPs and other city improvements that we all want. The new businesses in the City Center will pay other taxes (utility, franchise, communication, sales tax, etc.) these sources represent 68% of all revenues and can be spent on existing and new city services. Today, we have a single developer and a single plan to consider. This plan is to invest $400,000,000 into our City.
We are at a decision point and I wanted to get these facts to you to get your informed opinion.

DUMP FINE ~ $ 182,000
Who wudda thunk...That by making one dump...
We'd be charged up the wazzoo...
For something we didn't mean to do ?
Okay, it's not so funny that our city is being fined $182,000 for a mistake *we the resident's of Maitland* didn't know about or do - but when one city employee, not even an elected official, made the order...it now effects us all. And so instead of laughing it's really a crying shame that an erroneous "dump" did take place and now WE may have to pay.
But not if our Mayor Doug Kinson has anything to do about it. He thinks we're being singled out and since there's been no water contamination...he doesn't understand the fine.
And neither do I.
It's important to know what's going on in our community, our Maitland.

ELECTION DATE ~ When Will X Mark the Spot ?
I've heard a lot of comments made about our election date in March - the marjority stating that it's just not a good time for voter turn out. Because too many family's are on spring vacation or their energies or elsewhere with family matters, our poles don't reflect the true Maitland consensus. Now our city can save money by piggy backing on the presidential elections should we move our vote date.
What do you think would be best for our Maitland ?

HELP YOUR CHILD ~ Know Your City Ordinances
The following was reported in a recent Orlando Sentinel news article:State law requires (sexual) offenders to live at least 1,000 feet from where children gather.
In Deltona, Maitland, Oviedo, Leesburg and many other cities, offenders can't live within 2,500 feet -- about a half-mile -- of such places, typically schools, parks and day-care centers. Deltona also puts buffers around bus stops.

What Do You Recommend ?
Happy Friday, Maitland !
My good friend and neighbor, Dorine, asked a question and I'm hoping someone can help.
Dorine asks...
Does anyone have Embarq Cable for their TV service? Are you happy with it? Do you recommend switching from Bright House?
Embarq is trying to sell me – I’m thinking of switching – they claim more channels and I can order movies directly – can’t do that with the basic Bright House Plan.
Please share your opinions and experiences by using the comments link below...and help a neighbor (or perhaps many neighbors) make an informed decision !

SERVING on a City Advisory Board
Greetings Neighbors,Since I will soon be appointed to serve on the Citizen's Senior Advisory Board for our fine city, I am thinking you just might want to join me in my personal *walk* through the process. I don't know about you, but all this is brand new to the likes of me.
First off, when I finally awakened to the fact that I needed to become an active part of my community ~ I wasn't sure at all how to do it ! Even though I passed my 9th grade Civic's class with a "B" average, I now sorely regret that I was only studying to pass the test instead of to learn.
So I had to find out what I needed to do, therefore I asked both friends and city officials. They all said the same thing, "Attend the City Council Meetings and volunteer to sit on one of the advisory boards.". And that is precisely what I've done.
I'll close for now...but next time will share more insight into the process.
Blessings,
Ann Lanier *smiles*

PUBLIC SAFETY ~ Fire Station Location
"Oh Where, Oh Where, Does Our Little Fire Engine House Go, Oh Where, Oh Where, Should It Be ?"The people of our community spoke out at our City Council Meeting last night and the overwhelming majority said this:
***Do NOT build it at our Lake Minnehaha Park !
***But DO seriously consider building it on one of the developers sites ~ either the north section of The Trevi just off 17-92 or on the Sun Trust Bank parking lot on West George Avenue property.
Earl Emrick, our CRA Director, will be researching both options and reporting back to our City Council with his findings.
In addition, Rebecca Ritchey implored our council to dream big, do the impossible, think outside the box in order to secure the Packwood Apartments location because she believes it's THE absolute best location bar none. It's large, accommodating, centrally located and for sale.
Mayor Doug Kinson concurred and added that the Packwood properties would make a phenomenal park area since it is located so near a lake and that we do need to give this property very serious considerations.
Unless a viable location can be secured that would allow all Safety Public Buildings to be located on one site, the majority of residents agreed that the best suitable location for our Police Station would be on Fennel Road.

MEETING ~ City Council, Monday Night

Hello Maitland !
It's time again.
You have another opportunity to make your voice and choice known.
Your city needs you.
What: City Council Meeting
When: Monday, May 14, 2007
Where: City Hall Council Chambers
Time: 7:00PM
The agenda includes, but is not limited to, the following decisions:
* Appointments to Advisory Boards will be made for the following boards.
Transportation Advisory Board - 1 appointment, 5 applicants: Elizabeth Peele, Rebecca Ritchey, Terry Montville, Brian Wenhold or Michael Ruddy.
Senior Advisory Board - 2 appointments, 3 applicants: Sue Book, Earl Peterson and/or Ann Lanier.
* Florida League of Cities, Inc., - decision as to whether or not to spend monies for an Annual Convention Advertisement.
NOTE: We are a paying member. To learn more about this agency we belong to and what it does and can do for our city, see link below.
* Youth Programs Administration - decision as to whether or not to authorize third party sub-contractors to provide this service for our TEAM MAC, Maitland Activities Club, before and after school program.
And perhaps the most controversial item on the agenda will be...
* Location of Public Safety Buildings(s) - decision as to where to build. Currently there are 8 different scenarios before the board but Brian Jones, our Assitant City Manager, writes that "staff" recommends the Scenario A7 as the preferred scenario - City Hall to remain on Independence, Fire Station to be built in conjuction with Minnehaha Park and Public Safety (Police Station) to be built and include Fire Administration on Fennel site.
NOTE: At the MPN meeting yet another scenario was presented, that of building the Fire Station in conjunction with The Trevi's east development.
In addition, there has been an email circulating our community that includes a letter addressed to our Mayor and City Council in request of a Town Hall Meeting that was written by one of our community residents, Len Schmidt. Mr. Schmidt has concerns about city finances, especially in regard to the CRA, therefore he's asking for the answers to be presented at a meeting in May. Will this issue be presented during the open session at our next City Council Meeting ? Who's to know...
There's lots going on, neighbors.
Come join me and become a part of our community's SOLUTIONS.

CLEAN versus DIRTY...OLD versus NEW
Pollution is a dirty word.By attending last Wednesday nights MPN (Maitland Progress Now) meeting I learned a little more about our community. Statements made by the various developers (see prior post for comments) caused me to research some information, both on the Internet and by calling our city officials (see links below) and I learned that:
* Storm water is one of the largest sources of pollution of Florida’s waterways.
* We currently have highly polluted and untreated stormwater being dumped directly into our Lake Lily and a similar scenario exists for our Lake Minnehaha.
* Because of new Trevi and Ravinia development we’re getting a 3 ½ acre filtration/retention pond that should directly benefit the health of our Lake Minnehaha
* Because of the new Village of Lake Lily development’s plan, they will be instialling seven separate exfiltration trench systems, a nutrient-separating baffle box and stormwater filtration system in-line with the proposed outfall pipe to provide treatment of runoff collected and conveyed in the roadway stormsewer prior to discharge into our Lake Lily.
* The Brossier Company development plans include a total of 3 acres of “green roof” with the potential benefit’s being: reduced stormwater runoff; filtering pollutants and CO2 out of air; filtering pollutants and heavy metals from water; increase wildlife habitat.
So now I’ve begun to glean a better understanding about why the federal, state and local guidelines that govern new building development, such as the EPA, FDEP & SJRWMD regulations, are requiring much higher standards in order to approve permitting. These ever changing laws and regulations direct new development to provide plans and measures to stop or greatly curtail currently recognized polluted areas from advancing, avert future problems and, preferably, advance the refinement or rehabilitation of already polluted areas.
Therefore it seems extremely logical to me that NEWER development that replaces older development - especially the projects already underway along with the proposed downtown redevelopment project - will actually HELP our environment in many wonderful and innovative ways.
The Problem ~ unfortunately we’re not a pristine and ecologically balanced virgin environment anymore.
The Facts ~ Maitland is already developed but with grossly outdated or non-existent pollution controls.
The Solution ~ redevelopment appears to be THE best answer, perhaps the only answer, for cleaning up our environment.
Let’s work together to make the MOST of what we have by:
Re-Building Our Community
Re-Developing Our DownTown
Re-Newing Our Natural Resources
Maitland, Florida Re-ally can become an extremely unique and progressive niche.
I have the vision...do you ?

Community & City Concerns ~ Email Alert
Hello Once Again, Maitland !
According to the Orlando Sentinel, it appears that confidential Maitland Police information was somehow leaked and then circulated in the form of an email to many area residents. The content included identifying information about a man who police consider has performed activities suspicious in nature. Apparently many parents are fearful that he may be a sexual offender or, even worse, become one towards their children .
Don't let your child become a victim. Help your children by educating yourself first and then others. Be pro-active instead of re-active.
Many reports clearly state that the vast majority of children who are sexually abused are the victims of people that they know; parents, step parents, relatives, teachers, etc. The other group of sexual offenders spend a significant period of time infiltrating organisations or orchestrating opportunities to work with children or qualify in professions which afford them easy access to children and young persons in order that they are able to abuse them.
Unfortunately many parents believe that most sex offenders are predatory offenders who will covertly target a victim abduct them and sexually abuse them. Even though this type IS the most dangerous, they are the exception rather rule.
Interpol, the world’s largest international police organization, has information on their web site about crimes against children that includes an excellent article covering sexual abuse (see link below).
Be A Child's Hero Network web site offers a combined list of different suggestions on ways to talk with our children about sexual abuse (see link below). A quote from their site challenges us as parents and reads, "No one wants to have to tell their children about sexual abuse. On the other hand, do you want your child to learn about it from a child molester?"
Today can be a great day for a "wake up call" to parents. We can take affirmative action towards securing the best outcome and success for our children's life and happiness by educating ourselves and then them - right now. Once we have the tools, we are without excuse and must use them.
